Orlando Wrongful Death Attorneys
When the wrongful death of a person is caused by the act or negligence of another, the emotional loss is often overwhelming; however, the economic impact to a decedent’s family can be far more devastating. Under the Florida wrongful death statute, the deceased person’s Estate may bring a claim for injuries sustained and recover damages from the person or corporation responsible for his or her wrongful death.
Some personal injury lawyers have never handled a fatality claim. Others who advertise aggressively have no experience in the complexity of successfully building these challenging cases for trial, in the event a full-value settlement cannot be reached. Instead, many cases are settled for pennies on the dollar by non-represented family members or lawyers who rarely represent death victims and are unfamiliar with the true value of these significant claims.

Who May Bring a Florida Wrongful Death Lawsuit
The Florida Wrongful Death Act specifically sets forth who may bring a claim for wrongful death. Section 768.20, Florida Statutes, provides that an action for wrongful death shall be brought by the decedent’s personal representative, who shall recover for the benefit of the decedent’s survivors and estate, all damages specified in the Florida Wrongful Death Act.
Under the Florida Wrongful Death Statute “survivors” are limited to a decedent’s spouse, his or her children, parents and, when partly or wholly dependent on the decedent for support or services, any blood relatives and adoptive brothers and sisters. Survivors also include children born out of wedlock of a mother, but not the children born out of wedlock of a father, unless the father has recognized a responsibility for the child’s support.
The statute specifically prevents parents from recovering for the loss of companionship, instruction, guidance or for mental pain and suffering caused by the wrongful death of an adult child, if the death is due to medical malpractice. This restriction does not apply in non-medical malpractice wrongful death cases.
