$158,000 Final Judgment
Car Accident Tampa, Florida
Parties: Stamey v. Flowers
Florida Injury Attorneys: Florida Attorney Frank Fernandez of the Fernandez Firm.
Age/Sex/Occupation of Plaintiff: 26 / Female / Nursing Student
Negligence: Verdict on behalf of a 32-year-old woman who sustained neck injuries in a rear-end car accident. On June 15, 2009, at approximately 2:32 p.m., The Plaintiff was the restrained driver of a vehicle traveling northbound on Dale Mabry Highway, in Hillsborough County, Tampa, Florida. On this date, the Plaintiff’s vehicle was stopped in traffic, at a red light waiting to continue travel north on Dale Mabry Highway. As she waited for the signal to change, suddenly and without warning, the Defendant carelessly failed to stop and rear-ended the Plaintiff. The violent impact of the collision caused significant damage the rear end of the Plaintiff’s car and as a result she sustained multiple injuries including a focal disc herniation in her neck and multiple bulging discs in her neck, mid-back and low back resulting in a permanent impairment.
At trial, the Defendant denied she was negligent and responsible for Plaintiff’s injuries claiming that she had suffered a sudden medical emergency just prior to the impact. The defense failed to prove her case and in the end, the Defendant’s insurer Allstate Insurance Company was required to satisfy the excess Judgment and pay the Fernandez Firm $55,000 in legal costs due to their refusal to settle the case prior to trial.
