Breaking News! Florida Medical Malpractice Law

On June 8, 2017, in a huge victory for wrongfully injured patients, the Florida Supreme Court ruled that the law capping pain and suffering damages in medical malpractice cases is unconstitutional in Florida.  The controversial law, promoted and then enacted by the Florida legislature, imposed strict limits on the maximum amount of money damages an injured patient could recover for non-economic losses in a medical malpractice lawsuit.  In striking down this law, the majority of Justices found that the 2003 legislation violated the equal protection clause of the Florida Constitution concluding that “the caps on non-economic damages …arbitrarily reduce damage awards for plaintiffs who suffer the most drastic injuries.
